What the site is for

The site describes who we are, the services we offer, and work we have done with our partners, and lets you contact us. It is provided for general information. Nothing on it is an offer to provide services on particular terms.

Working with us

Every engagement is governed by a separate written agreement, such as a proposal, statement of work or master services agreement, signed by both parties. If anything in those documents conflicts with these terms, the signed agreement prevails for that engagement.

Sending us a message through the contact form, by email or by phone does not create a client relationship or any obligation on either side. Please do not send confidential information until an agreement, or a non-disclosure agreement, is in place.

Case studies, results and articles

Case studies describe work with specific partners, in specific markets, over specific periods. The results we report are stated with their period and baseline and reflect those circumstances; they are not a promise or guarantee of the results any other business will achieve.

Articles on the site share our experience and opinions for general information. They are not legal, financial, tax or other professional advice, and you should take advice specific to your situation before acting on them.

Intellectual property

The site, including its text, design, graphics, photography, video and code, is owned by i9media or used with permission, and is protected by copyright and other laws. You may view and print pages for your own non-commercial reference. You may not copy, republish, modify or distribute site content, or use it to train or build other products, without our written permission.

The i9media name, logo and slogan are our trademarks. Client names, logos and brand materials shown on the site belong to their respective owners, appear to describe our work with them, and do not imply that those owners endorse anything beyond that work.

Acceptable use

When you use the site you agree not to:

• use it in any way that breaks the law or infringes anyone else’s rights;
• send spam, malicious code or misleading information through the contact form;
• attempt to gain unauthorized access to the site, its hosting or any connected system, or interfere with its operation;
• scrape, harvest or bulk-download content except as search engines do to index public pages.

Links to other sites

The site links to partners’ websites, social platforms and other third-party sites for convenience. We do not control them and are not responsible for their content, availability or practices. Visiting them is at your own discretion and subject to their terms.

No warranties

We work to keep the site accurate and available, but we provide it "as is" and "as available". To the fullest extent permitted by law, we make no warranties, express or implied, about the site, including warranties of accuracy, merchantability, fitness for a particular purpose or non-infringement, or that it will be uninterrupted or free of errors or harmful components.

Limitation of liability

To the fullest extent permitted by law, i9media and its team will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from your use of, or inability to use, the site, even if advised of the possibility. Our total liability for any claim relating to the site is limited to one hundred US dollars (US$100). Some jurisdictions do not allow these limitations, so they may not apply to you in full. This section does not limit liability under any signed engagement agreement, which sets its own terms.

Indemnity

If you use the site in breach of these terms or the law, you agree to indemnify and hold i9media harmless from the resulting claims, losses and reasonable costs, including legal fees.

Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute relating to the site will be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to their jurisdiction.

Changes to these terms

We may update these terms from time to time. The effective date at the top shows when they last changed. Continuing to use the site after a change means you accept the updated terms.

General

If any part of these terms is found unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver of it. These terms, with the Privacy policy, are the whole agreement between you and us about the site.
